<서울대병원 청소미화 노동자 파업지지를 위한 진보 사회단체 기자회견문>
서울대병원은 청소미화 노동자에 대한 노동탄압을 중단하고 사태해결에 직접 나서라!
서울대병원 청소미화노동자들의 파업은 한국노동현실의 축소판이다. 복수노조를 이유로 사측이 노동조합을 인정하지 않고, 실질적인 근로관계를 결정하는 원청이 노동법상 사용자가 아니라는 이유로 책임을 회피하고, 업무방해로 노동권을 제약하는 현실이 한데 어우려져 있다. 이로 인해 우리 사회에서 일하는 노동자 중에서도 가장 약자로 볼 수 있는 50,60대 여성 비정규노동자들의 파업이 장기화되고 있다. 민들레분회 파업의 장기화는 이명박 대통령의 일그러진 노동관과 노동조합에 적대적인 사용자들로 인해 우리 사회가 사회적 약자의 절박한 요구마저 해결할 수 있는 능력을 잃어 가고 있음을 반증하고 있다.
이들 청소미화노동자들은 지난 5월 공공노조에 가입했지만 청소용역업체인 대덕프라임은 회사에 기업별노조가 이미 있다며 교섭을 거부했다. 노조는 법원에 단체교섭 응낙가처분 신청을 제기해 지난 9월 "산별노조와 기업노조를 복수노조로 볼 수 없으므로 사용자는 노조와 성실히 교섭하라"는 판결을 받아냈다. 하지만 대덕프라임은 이러한 법원의 판결도 무시하고 무려 30차례가 넘는 교섭요청을 거부했다. 민들레분회가 11월 파업에 들어가자 열린 실무접촉에서 대덕프라임은 모든 요구사항에 대해 수용을 할 수 없다고 밝히면서 파업으로 인해 병원과의 재계약이 어려워질 수 있다고 협박을 하고 있다.
청소미화노동자들의 실질적인 근로관계를 결정짓는 서울대병원은 노동법상 사용자가 아니라는 이유로 문제해결을 위한 노력을 회피할 뿐만 아니라 인권침해와 노동탄압을 자행하고 있다. 서울대병원은 청소미화노동자들이 서울대병원에서 일하고 있는데도 불구하고 근로계약을 맺은 당사자가 아니라며 집회,선전전 등 병원 내 모든 행위를 불법으로 몰고 있다. 더구나 서울대병원은 경비들을 동원해 집회를 하지 못하도록 방해를 하고 있다. 이 과정에서 서울대병원에서 동원한 경비들은 50,60대 여성 비정규노동자들에게 입에 담지 못할 욕설과 폭력을 자행했다. 결국은 여성 비정규노동자 2명이 폭행을 당해 갈비뼈에 금이 가는 등 병원에 입원하는 사태까지 벌어졌다.
청소미화노동자들의 파업을 무력화시키기 위한 서울대병원의 노동탄압은 물리적인 폭력과 욕설에서 그치지 않는다. 대체인력 투입과 최근 노동조합의 파업에 전가의 보도처럼 사용되고 있는 업무방해죄를 걸어 노동3권을 제약하려 하고 있다. 서울대병원은 민들레분회와 의료연대 서울지부 간부들을 업무방해라며 고소고발을 남발했다. 최근 합법적인 절차를 지킨 철도파업을 불법파업으로 낙인 찍고 김기태 운수노조 철도본부장을 비롯한 간부들을 구속한 것도 업무방해죄였다. 노동자 파업에 업무방해죄가 광범위하게 적용되는 국가는 전 세계에서 이제 한국이 유일하다. 상황이 이렇다보니 국제노동기구(ILO)도 한국의 업무방해죄를 개정하라고 권고했다. 국립대병원이 청소미화노동자들을 대상으로 전쟁을 벌이듯 노동탄압을 하고 있는 현실에 우리는 분노를 억누를 수 없다.
남들은 곤히 잠든 새벽 4시부터 일하는 서울대병원 청소미화노동자들은 10년간 최저임금에 달하는 저임금을 받았다. 주6일 근무에, 1달에 2번 밖에 쉬지 못하는 높은 노동강도 속에서 일하면서도, 고된 노동에 몸이 아파 휴가를 쓰려 해도 본인이 일당을 주고 대체인력 쓰지 않으면 하루도 쉬지 못했다. 민들레분회 조합원들의 파업이 오늘로 23일차에 이르렀다. 이들 청소미화노동자들은 정년을 연장해 고용을 보장하고 남들처럼 휴일에는 쉬자는 것과 저임금을 개선해달라는 소박한 요구를 하고 있다. 그리고 12월말에 있을 하청업체와의 계약서에 청소노동자미화노동자들의 정년, 근로시간 등을 명시해달라고 촉구하고 있다.
앞서 열린 민들레분회 파업지지를 위한 청소미화노동자 증언대회에서 원청 사용자의 책임 있는 자세가 하청 노동자들의 고용안정과 노동조건 개선을 불러온다는 증언이 잇달았다. 성신여대는 대학 내 청소미화노동자들의 고용보장을 약속하고, 연세대는 청소미화노동자들의 체불임금을 직접 해결하기도 했다. 우리는 국립대병원인 서울대병원에게도 법적 책임 여부를 떠나 원청사용자로써 노동탄압을 중단하고 문제해결을 위해 노력할 것을 강력히 촉구한다. 아울러 서울대병원 청소미화노동자들이 노동조합으로 가입한 것은 정규직 노동자들의 노력으로 가능했다. 서울대병원 정규직노동자들의 노력으로 병원 내 간병인노동자, 식당노동자, 청소미화노동자 등 하청업체노동자들이 공공노조로 가입했다. 우리는 여기에서 희망을 보지만, 서울대병원의 하청노동자들에 대한 탄압에서는 절망을 본다. 희망을 올곧이 지켜나가는 것은 우리 모두의 책임이다. '민'주노조의 '들'녁에 새로운 '미'래를 만드는 민들레분회의 소망을 우리가 지켜나갈 것이다.
